Terms of Service
Last updated: August 2026
What this covers
These terms apply to any Admin account on MrSanmiguel IOT Portal — the multi-tenant IoT platform operated by Ysanmiguel. By creating an account, you agree to them.
Your account
You're responsible for the accuracy of the data you enter, for the clients you invite, and for keeping your login credentials to yourself. Admin accounts should not be shared between multiple people — each real user needs their own login.
Reselling to your own clients
You may invite your own clients to view their devices through the platform. You may not misrepresent MrSanmiguel IOT Portal as your own proprietary software when directly asked, and you may not resell Admin-level access itself.
Subscriptions and billing
Plans are billed monthly based on the device tier you select. New accounts get a 14-day trial with full access. If your trial ends without adding a payment method, the account is restricted immediately; if a payment fails instead, you get a 7-day grace period first. Restricted accounts keep their data but lose the ability to manage clients, devices, and rules until payment resumes. Accounts left unresolved for 90 days are permanently deleted, including all client, group, and device data.
You can cancel at any time. Downgrading to a lower tier requires your device count to already be under that tier's limit.
Service availability
We work to keep the platform running reliably, but we don't currently offer a formal uptime guarantee. If you're monitoring safety-critical infrastructure, treat MrSanmiguel IOT Portal as one layer of your monitoring, not the only one.
Changes to the platform
We may add, change, or remove features, functionality, or pricing at any time, with or without prior notice.
Platform role — we provide the tool, you operate it
MrSanmiguel IOT Portal provides the software infrastructure for building and running automation rules, dashboards, and device monitoring. We do not design, review, approve, test, or vouch for the correctness, safety, or suitability of any specific rule, threshold, condition, or command you or any Admin configures — including rules drafted with the help of the AI-assisted rule builder, which is a drafting aid only and does not guarantee the resulting rule is correct, safe, or fit for your purpose.
The logic of any automation rule — what it monitors, what condition it checks, what command it sends, and whether that logic is appropriate for its real-world context — is entirely the Admin's own design decision, made with knowledge we don't have of the physical setup, the stakes involved, and what "correct" means for that specific use case. We are not responsible for any consequence of a rule that is logically incorrect, poorly thought-out, missing a necessary condition, or otherwise not doing what its author actually needed it to do — as opposed to a platform-side failure to execute a correctly-designed rule as configured, which is addressed separately under "No warranty" and "Limitation of liability" below.
This distinction applies the same way to a Client acting on a dashboard or alert an Admin configured for them: MrSanmiguel IOT Portal is not responsible for how an Admin chose to present data or set up alerts for their own Clients.
Prohibited high-risk uses
You may not use MrSanmiguel IOT Portal, and no data, alert, dashboard, or automation rule from MrSanmiguel IOT Portal may be relied upon, in connection with:
- Life support, life-sustaining, or life-critical equipment of any kind.
- Medical devices, medical monitoring, or clinical care of any patient.
- Monitoring or care of a vulnerable person (a child, an elderly person, a person with a disability, or anyone whose safety depends on a timely response) where a missed, delayed, or incorrect alert could result in harm.
- Safety systems for which failure could result in death, personal injury, or serious property damage, including but not limited to fire suppression, gas detection, structural monitoring, or emergency shutoffs, unless backed by an independent, non-MrSanmiguel IOT Portal hardware fail-safe that does not depend on this platform, an internet connection, or any third-party service to function.
- Any use restricted or regulated by law that the platform is not certified or licensed for (e.g. medical device regulations, food safety regulations requiring certified monitoring equipment, aviation, nuclear, or other regulated critical infrastructure).
If you are unsure whether your intended use falls into one of these categories, contact support before deploying it — don't guess.
Automation rules and physical safety
Rules you configure can send real commands to real devices automatically, without a human confirming each action. You are solely responsible for independent hardware fail-safes and shutoffs that function without MrSanmiguel IOT Portal, sane thresholds and cooldowns, and testing any rule before relying on it — so that a misconfigured rule, bad sensor reading, delayed message, bug, or platform outage cannot cause damage or harm on its own. Never treat MrSanmiguel IOT Portal as the only safety mechanism protecting physical equipment, people, or animals, and never automate an action whose failure mode you cannot afford.
Sensor data, connectivity status, and alerts shown on the platform may be delayed, missing, duplicated, or wrong, for reasons including but not limited to device malfunction, network conditions, third-party service outages (including the message broker, database, hosting provider, or notification/push services), or software defects. You must not treat any single reading, alert, or absence of an alert as confirmed ground truth without independent verification where the consequence of being wrong matters.
Acceptable use
Don't use the platform for anything illegal, to facilitate or conceal illegal activity, to access accounts or devices that aren't yours, to circumvent the device limits attached to your plan, or for any purpose listed under "Prohibited high-risk uses" above. Don't store, transmit, or process another person's sensitive personal data, health data, or data concerning a vulnerable individual unless you have an independent, lawful basis to do so and have made your own assessment of the applicable data protection law in your jurisdiction — MrSanmiguel IOT Portal is a general-purpose monitoring tool and does not represent itself as compliant with any specific regulatory framework unless stated in a separate signed agreement.
We may suspend or terminate any account we reasonably believe is being used for a prohibited purpose, and may report illegal use to the relevant authorities.
No warranty
The platform, including all dashboards, alerts, automation rules, data retention, and any AI-assisted features, is provided "as is" and "as available", without warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not warrant that the platform will be uninterrupted, timely, secure, or error-free, or that any defect will be corrected.
Limitation of liability
To the maximum extent permitted by law, MrSanmiguel IOT Portal and Ysanmiguel are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from or related to your use of the platform, even if advised of the possibility of such damages.
Indemnification
You agree to indemnify and hold harmless MrSanmiguel IOT Portal and Ysanmiguel from any third-party claim, loss, liability, damage, or expense (including reasonable legal fees) arising from: your use of the platform in violation of these terms, your violation of any law, your violation of any third party's rights, or any harm caused to a third party (including your own Clients or their end users) arising from your configuration of the platform, your devices, or your automation rules.
Third-party services and force majeure
The platform depends on third-party infrastructure (hosting, DNS, CDN, payment processors, push notification services, and others) that we do not control. We are not liable for any failure or delay caused by circumstances beyond our reasonable control, including but not limited to internet or power outages, third-party service failures, denial-of-service attacks, or events of force majeure.
Data accuracy and security
We take reasonable technical measures to protect your account and device data (per-device TLS certificates, encrypted traffic), but no system is completely secure. We do not guarantee that the platform will be free from unauthorized access, and you are responsible for keeping your own login credentials confidential and for your own devices' physical and network security.
Termination
We can suspend or terminate accounts that violate these terms. You can close your account at any time by contacting us.
Changes
We may update these terms as the platform evolves. Continued use after an update means you accept the revised terms.
Severability
If any provision of these terms is found unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be read to give effect to its intent as closely as possible within the limits of applicable law.
Governing law
These terms are governed by the laws of England and Wales.
